IMPHAL: The Judicial Magistrate, First Class Imphal West-II has rejected the bail application filed by a senior resident surgeon of JNIMS Hospital and his personal driver and remanded them into judicial custody in connection of blackmailing and sexually assault charges filed by a married woman.
The accused doctor was named as Dr. Pukhrambam Kiran, 40 years, son of Dr. P Brajamani of Wangkhei Yonglan Leirak was arrested on March 17, 2020, and his driver Norel Sorokhaibam Meitei, 24, son of Leishang Sorokhaibam of Chairel Makha Leikai were arrested on March 26 and they were put in police custody remand till Monday in connection with the case.
They were produced before the court of JMFC, Imphal West-II along with the prayer for remanding them into judicial custody remand for smooth investigation of the case.
On the other hand, the defense counsels of the doctor and his driver filed remand objection along with the prayer for releasing them on bail.
The court on perusal of the case record and after hearing counsels of both side found it satisfactory with the police prayer and thus remanded the duo into judicial custody remand.
The investigating officer of the case through APP submitted that the accused was arrested yesterday at around 4 pm by a team of Nambol police based on the complaint lodged by the victim stating that in the year 2010, she was assigned for internship course for General Nursing and Midwifery (GNM) at JNIMS Hospital for six months and during that period she met the surgeon and such casual acquaintance ultimately culminated into a love affair.
In the month of September 2010, the accused took her to a roadside restaurant located along the Tiddim Road and forcibly raped her inside and while committing the act took photographs of her in nude using his mobile phone without her consent.
It was further submitted that after the incident the accused assured her that he would definitely marry her and convinced her to believe in his assurances. They had physical relation whenever they went for outing at different location and most of the time the accused used to take photographs of her in the nude. Whenever she insisted against taking such photographs the accused made threats to upload the previous photographs in social media if she refused his demands.
It is further stated that the accused used to threaten the victim by sending her nude pictures at her mobile phone through WhatsApp and insisted to comply with whatever he asked the victim to do.
The accused eloped and married with another girl on February 2011. However, he insisted on resuming the relationship with the victim and used to make call to her. He threatened that he will prevent her from getting married with someone.
The victim got married in February last year with the hope that she would be able to establish her family life peacefully. But one day in January 2020, an envelope containing some nude photos of the victim along with one micro SD was handed over to her mother through two unknown women. At the same time some nude photographs of the victim was also delivered to the house of one local Meira Paibi leader.
It was also mentioned that the even the accused made threatening call to the elder brother of the victim concealing himself to be a member of an insurgent group and told him to come to Moreh along with the victim in connection with her affair with the doctor.
On 9 February 2020 early morning the accused hurled some nude pictures of the victim at the gate of her parental home and the same was witnessed and recovered by the victim’s mother and the action of accused was recorded in the CCTV Camera installed at the premises. On March 7 early morning six of the same pictures containing photographs and scribbled with abuse words were recovered.
It was further submitted that in the month of July last year, the accused had threatened to the husband of the victim through telephone with the information that he had physical relationship with the victim in the past. In that regard the husband made a complaint at Porompat police station and thereafter it was settled after entering into an agreement between the two parties.
The accused had lowered the victim’s prestige and reputation, insult and outraged her modesty, caused sexual harassment with criminal intimidation and conspiracy with common intention hence a case was registered for investigation, it was stated.
During the interrogation the accused doctor admitted capturing nude photographs of the victim using his mobile phone whenever they had physical contact at different places. Thereafter a cordial relationship could be developed by way of blackmailing using the victim’s nude photographs already in their custody and as a result he had literally acquired possession over her.
It is further agreed by the accused that the victim decided to settle her life peacefully and married to another man. She ignored his phone calls and avoided his approaches which made him agitated and furious and so he started plotting to defame the victim.
On July 17 last, the doctor sent some nude pictures to her husband through WhatsApp and the incident was reported to police station by victim’s family. He was arrested by the police and after considering the plea by his family members as it will ruin their reputation, an amicable settlement was reached between the two parties.
The accused further admitted to have dispersed the nude photographs of the victim women at the gate of her parental and matrimonial house with the assistant of his staffs and on further interrogation it was revealed that on February 24, he alone drop some nude photographs of victim near the gate of matrimonial house of the victim and by driving a two wheeler moped and again on March 7 early morning he again dropped some nude photographs of victim at the gate of victim parental home and while committing the crime his driver accompanied by his driver to whom he had not disclosed any of his activities as he had brought his driver on pretext of having fresh air.
The IO also submitted that on examination of some staff of accused doctor, it was ascertained that two of his staffs were also directed by the accused doctor to hand over an envelope to the mother of the victim women.
Accordingly, his personnel driver Norel Sorokhaibam Meitei was arrested yesterday night and after proper enquiry one i20 car that was used in the commission of the crime was also seized by police team.
The court on perusal of the case and after hearing counsels from both side found it satisfactory with the police prayer and thus rejected the bail application filed before the court and thus remanded the doctor and his associate driver into judicial custody remand.
