IMPHAL: The Session Judge Imphal West has fixed April 17 for further hearing of charges leveled against 3 cops in connection with alleged fake encounter/extra judicial killing of Ningthoujam Khaiba on November 13, 2006.
The hearing was in against the alleged accused cops then Havildar Khundongbam Inaobi S/o Kullo of Yairipok, then head constable Thounaojam Herojit s/o Shyamsunder of Lamdeng Awang Leikai and then constable Longjam Chingkeihunba S/o (L)Yaima of Keishamthong Longjam Leirak in connection with the charge sheet submitted against them by CBI/SIT in connection with the alleged fake encounter of Ningthoujam Khaiba near NG Mani College Imphal Ukhrul road.
The court on Friday heard the submission of both parties partly and fixed April 17 for further hearing of charges leveled against the alleged accused in the CBI/SIT charge sheet.
The case was transferred from Session Judge, Imphal East to Session Judge, Imphal West after an application was filed by alleged accused cops praying for for transferring the case of the trial to other competent court as the Judge of the Session Court, Imphal East was inquiry officer of the same case as directed by the Guwahati High Court, Imphal bench as inquiry number 1 of 2010.
It may be mention that on July 1 Investigating Officer of the CBI/SIT DSP B Ranjan Roy of CBI Special Crime Branch Kolkata had submitted the charge sheet against five alleged accused cops including two deceased cops the constable Th. Lungdim and the constable Pashel Angson Anal.
The charge sheet was submitted before the court of Chief Judicial Magistrate, Imphal East court after the completion of the investigation as per the direction from Supreme Court of India for setting up Special Investigation team (SIT) of police officer from outside the state of Manipur to investigate instance of alleged fake encounter/extra judicial executions and thereafter prosecute the offence in accordance with law.
The court took up cognizance against the alleged accused cops only after the concern authority of the state government sanction prosecution of the alleged accused on August before commit the case before the Session Court Imphal East for trial as the case is exclusively trailable by the Court of Session.
It may also be mention that the deceased Ninthoujam Khaiba alias Binoy of Keirenphabi was reportedly gunned down by a team of Imphal West commando on November 12, 2006 few hours after he was released from Manipur Central Jail Sajiwa while heading toward his home with his father and his advocate in a Maruti Van near NG. Mani College.
During that time the family members of deceased N. Khaiba alleged that a team of commando personnel stopped them their vehicle on which deceased N. Khaiba along with his father, brother and Advocate were on board near NG. Mani College on their way to home and shot to death N. Khaiba on spot after been pulled down from the vehicle. Ningthoujam Khaiba was released on that day after he was detained under the National Security Act ( NSA) after been arrested by Police team from near Oinam Dam, Mayai Lambi on October 2005.
