IMPHAL: Veteran firebrand politician Okram Joy has said that the allegations leveled by ex-MLA S Subhaschandra against two Congress MLAs namely K Meghachandra and Th Lokeshwor and BJP Minister Thongam Bishwajit that he was coerced into signing resignation letter and subsequent filing an FIR at Patsoi PS constituted breach of privilege and contempt of House.
According to powers, privileges and immunities of parliament and its members as enshrined under Article 105 of the Constitution, states that it is a breach of privilege and contempt of the house to make speeches, or to print or publish any libels, reflecting on the character or proceedings of the house or its committees or any member of the house for or relating to his character or conduct as a member of parliament.
According to the recent verdict of SC, if an FIR is registered against an individual, copies of the FIR and details of the charge should be intimated to the individual as well as the relevant magistrate, O Joy said and questioned the OC of Patsoi PS whether he had intimated the concerned MLAs or submitted a report to the concerned magistrate before registering the FIR case.
He also questioned the Chief Secretary in charge of Home, and DGP if they had followed the proper legal proceedings while registering the case against the MLAs who are enjoying Powers, privileges and immunities under Article 105 of the Constitution.
Blaming the police department, the seasoned politician also alleged that Police is working under diktat of the rulers of the Government instead of Law. It is a very unfortunate scenario the state is witnessing today, he said.
“Earlier, I had appreciated ex-MLA Subhaschandra as a hero for his guts to resign from membership of the Manipur Legislative Assembly as he felt dissatisfied with the party to which he was affiliated. He turned to zero from hero after he claimed that he was coerced into signing the resignation letter under extreme duress”, O Joy said dubbing the ex-MLA as an immature politician with a childish nature.
It is quite preposterous to hear that an MLA was physically assaulted and coerced into signing a resignation letter, he added.
Regarding the allegation that the three BJP MLAs were coerced into signing the resignation letters, O Joy said that any legislator can move a privilege motion in the house under rule no 79 of rule of procedure. House is the own authority to punish and expel any legislator for misconduct. Hence, House can move a motion of breach of privilege and contempt of House against ex-MLA Subhaschandra and punish him as it deems fit.
