Sunderchand remanded under judicial custody, Ranjit released on bail

IMPHAL: The Chief Judicial Magistrate, Imphal West on Saturday remanded the alleged accused Moirangthem Sunderchand who is the Managing staff of Dineshwori Higher Secondary School, Canchipur in judicial custody remand till March 14, 2020, while alleged co-accused Proprietor of New Vision Hostel, Canchipur Nameirakpam Ranjit was released on bail on his execution of Rs. 50, 000 PR bond with surety of same amount.

The alleged accused persons identified as Moiranthem Sunderchand (33), son of Chaoba of Kyamgei Mamang Leikai and Nameirakpam Ranjit (43), son of Yaima of Tentha Khunjao at present residing at Manipur University First Gate Canchipur was arrested in connection with the leakages of Class XI questions papers conducted by COHSEM by police team on February 22 and February 25 respectively.

The IO of the case after the completion of police custody remand of alleged accused persons produced them before the court on Saturday along with the prayer remanding them into judicial custody remand for further investigation of the case and on the other hand, the counsels of the alleged accused person filed remand objection along with the prayer for releasing on bail.

A regular case was registered based on the complaint lodge by the Secretary COHSEM that questions paper of five subjects of Class XI examination, 2020 found circulated on social media WhatApps after which effort were made to backtrack the source and sought back the questions paper back to Secretary COSHEM office and found that some school have opened the sealed question papers are being seized for investigation.

The question papers which were returned back by the alleged accused Moiranthem Sunderchand was found that the sealed of question papers were cut and opened and on questioning the alleged accused admitted to have cut and opened the sealed question papers and took photographs of question papers using cam scanner apps.

Further, during the course of investigation after taking into seven days’ police custody remand the alleged accused revealed that he took the photographs of COHSEM Class XI question papers of five subjects and the same was sent through bluetooth to one Nameirakpam Sumila wife of Nameirakpam Ranjit who is the proprietor of New Vision Hostel at Canchipur.

The IO further submitted that the investigating team along with women police rushed to the premises of Nameirakpam Sumila for examination in connection with the case and to seized all possible evidences and seized one mobile phone used by Nameirakpam Sumila which she was instructed her to appeared before the investigating team on the next day but Nameirakpam Sumila did not appear nor contacted the IO and every possible means to contact her was futile on the said next day.

The IO also further stated that in another lead of the investigation it was found that the leaked questions papers was also propagated by one Juvenile who is appearing in the examination and on questioning the juvenile reveals that on February 15 evening Nameirakpam Sumila sent the English question papers from her mobile phone to his mobile phone whatapps when he was in hostel and later on February 18 morning Nameirakpam Sumila again sent question papers of four subject through whatapps and informed him that the question papers were provided by the alleged accused Moirangthem Sunderchand and also directed not to disclose the question papers to anyone.

The IO also stated and revealed that on February 22, 2020 at around 9.30 pm Nameirakpam Sumila along with her elder sister including with some peoples went to the residence of juvenile for confronting regarding the propagation of the leakages of question papers which was also repeated the following days and alleged that the juvenile was also instructed by Nameirakpam Sumila to give statement that he took the copy of the question papers without her knowledge or consent if interrogated by Police.

On such ground breaking revelation from the juvenile, an immediate searched was conducted again for causing arrest of absconding Nameirakpam Sumila was not found in her hostel and nearby and on the following day a searched was re-conducted and arrested Nameirakpam Ranjit along with his mobile phone, husband of Nameirakpam Sumila who is highly suspected to be involved in committing in the crime and also in threatening the juvenile.

Thus, the IO prays not to release the alleged accused persons on bail during the period of investigation as it is apprehensive that they will surely put all possible effort to tarnish all evidence and also hamper many other witnesses of the case who are to be examined in due course of investigation and prays for remanding on judicial custody remand.

The court on perused of the case record and after hearing the submission of APP and defense counsel of the alleged accused persons found satisfied with the police prayer and remanded the alleged accused as Moiranthem Sunderchand into judicial custody remand till March 14, 2020, while the alleged co-accused was order to release on bail on his execution of Rs. 50, 000 PR bond and surety of same amount.

On the other hand, the Session Judge, Imphal West had issued interim bail to Nameirakpam Sumila in regard of anticipatory bail filed in connection with the case to released her on her execution of PR bond of Rs. 50, 000 with surety of same amount in event of arrest and fixed March 7, 2020 for report and hearing of filed anticipatory bail.
