IMPHAL: Special Judge ND&PS, Thoubal A Noutuneshwari Devi has cancelled the bail granted to Myanmarese drug smuggler Md Kyaw Kyaw Naing alias Adbul Rahim and ordered that he be kept in judicial custody till the completion of his trial in connection with seizure of a large quantity of drugs.
The accused was granted bail by a court of district and sessions judge Tara Devi after he was arrested in connection with the seizure of a consignment of 40 lakhs WY tablets from Phoudel Keirambi that is estimated to worth around Rs 400 crores. The bail order was issued on January 28, 2020.
However, the investigating officer of the case Sub-nspector O. Inaobi Singh had forwarded a petition arguing that the survey amount of personal bond and surety of two sureties’ amount is Rs. 10,000 each and are not sufficient as the quantity of the drug seized is over and above the commercial quantity.
It further submitted that the charge sheet being No. 18/1BL-PS2020 has been submitted before the court and took cognizance against all the accused persons. The case is fixed on 04-12-2020 for charge hearing. On the other hand, as the said accused person is a citizen of Myanmar and if the said accused is released from jail, there were doubts that he may abscond and may vitiate and make futile the trial of the case.
As such, his detention in jail till completion of this trial is highly necessary and the IO had prayed for cancellation and modification of the district and sessions judge order under Cril. Misc. (5) case No. 186 of 2019.
Hence, the bail order dated 28-01-2020 passed as Cril. Misc. (B) Case No. 186 of 2019 stands cancelled and the accused be kept in judicial custody till the completion of this trial case, the new order stated.
