IMPHAL: At least10 persons including the manager of Shivalaya Construction Co Pvt Ltd were arrested in connection with the complaint case of illegal mining of sand and stone from Sekmai River. There were, however, released by JMFC Imphal West II on their execution of Rs. 50, 000 PR bond with surety of same amount in last two days.
The arrested persons were produced before the court of JMFC Imphal West II by a team of Sekmai police for necessary court proceeding on Wednesday and today in connection with the complaint case of Director trade and commerce industries Manipur.
According to the report submitted before the court, it is mentioned that on receipt of some information of illegal mining at Sekmai River near Sekmai bazar, the internal task force on prevention of illegal mining of directorate of trade and commerce industries, Manipur carried out spot inspection of the area on March 3, 2020.
The team was assisted by Imphal West district Police and personnel of Sekmai police station and arrested ten persons allegedly involved in illegal mining of sand and stones from Sekmai river along with the seizer of two Tata trippers, two JCB Excavators and one JCB Proclaim as provided under rule 68 (1) and 3 of the Manipur minor mineral concession rules 2012.
The report further mention that the report was also received on activities connected with illegal mining at a nearby area of a company M/S Shivalaya construction co-private limited without any singing of mining activities however the company was found to had transported stone and stocking them without valid documents in violation of rule 5 (1) of the Manipur Minerals Preventive of illegal mining, storage and transportation rules 2018.
It is further alleged that the company was found washing stone chips and discharging the waste directly to the Sekmai River without treatment thus polluting the river and since the company was carrying out the illegal activities in violation of the rules Satendra Kumar of Nawada Bhojpur manager of the Shivalaya construction co-private limited was arrested.
The other arrested persons has been identified as Hijam Mohen of Sekmai Koujengleima, Khonjembam Naobi of Koujengleima, Sanasam Kiran of Sekmai laipat, Phanjoubam Shantikumar of Sanapat Andro, Charoibam Premjit of Tabungkhok Awang Leikai, Oinam Thoi of Maharabi Awang leikai, Moikhongbam Prakash of Keirao Wangkhem mayai leikai, Leishangthem Shantikumar of Thoubal Leishangthem and Angom Khelemba of Phayeng Awang Leikai.
The apprehended tolls and heavy equipment has been kept in the custody of Police station and prays for taking up appropriate action.
The court after perused of the Cril C case report submitted of Directorate trade and commerce industries Manipur allowed all the arrested persons to released on bail on their execution of Rs. 50, 000 PR bond and surety of same amount yesterday.
Only one arrested person Satendra Kumar of Nawada Bhojpur manager of the Shivalaya construction co-private limited were able to furnished their necessary PR and surety bond on March 4, 2020 before the court and the court had remanded remaining nine other in police custody for 2 days till March 5, 2020.
The remaining nine other arrested persons were again produced before the court on March 5, 2020 and after their execution of necessary PR and surety bond they were released on bail with the direction that they should not repeat the offence leveled charges against them and with the direction to appear before the court on March 21.
Mention may be made that the Division Bench High Court of Manipur on February 13 had directed to all the state government respondents in connection with PIL on preservation of Thoubal River not to permit any quarrying activity, transportation etc and particularly the respondent number 12 of the PIL Director Trade, commerce and Industries Government of Manipur not to grant any further prospecting lease or license provisional or regular quarrying lease or license without the leave to the court.
