48-year-old man convicted in drug case, sentence hearing on Monday

 IMPHAL: A 48-year old man named Lalthang Lhouvum, who was arrested along with 3 kilograms of opium on August 19, 2014 by a joint team of City Police and Narcotic Cell at near Kasturi Bridge, has been convicted by a special court of ND&PS on Friday.

Judge A Noutuneshwari Devi has fixed June 29 for sentence hearing to announce the quantum of punishment against the convict.

Soon after the announcement of the judgment order by special court, the convict Lalthang Lhouvum, son of Thangkholun Lhouvum of Motbung Bazar who was on bail was arrested and taken by a team of City police station and lodged in judicial custody.

The judgment order was announced on Friday, after it was kept on reserved after the final hearing of the trail case on March 16 and the case was put up in motion after a joint application filed by defense counsel of the convict and Special PP on June 17 for putting up the matter before the court as per the notification of High Court of Manipur and after the case was finally heard on March 16, but the judgment could not be announced due to the lockdown of COVID-19 pandemic.

The convict was arrested on August 19, 2014 when he was moving towards the public toilet located on the southern side of Kasturi Bridge, Nagamapal holding a plastic bag and on checking the plastic bag police found three numbers of polythene packets containing 1 kilogram of opium each.

After the completion of investigation, the IO of the case then Sub-Inspector N. Suresh submitted the charge sheet before the court under Section 18 of ND&PS Act and the charges were framed against the convict on April 11, 2016. In order to prove the charges leveled against the convict, prosecution produced 8 prosecution witnesses before the court and the convict produced two defense witnesses before the court.

The special court after the hearing special PP and defense counsel in connection with the trial of the case observed that it is quite clear that police after duly complying the procedural safeguard provided under the ND&PS Act recovered the contraband opium from the possession of the convict.

Special court considering all the evidence adduced by the prosecution witness and document exhibited, came to the conclusion that the prosecution has proven beyond the reasonable doubt against the Lalthang Lhouvum that he had possessed 3 kilograms of opium punishable under Section 18 r/w Section 8 of ND&PS Act.

Hence, Lalthang Lhouvum was convicted by the Special Court under Section 18(b) of the ND&PS Act and fixed June 29, 2020 for sentence hearing to announce the quantum of punishment.
