Main accused remanded to police custody, suspect released on bail
IMPHAL: Special Court POCSO, Imphal East on Friday remanded the alleged rape accused to four days police custody remand till March 2, 2020 while releasing suspect on PR bond of Rs. 50, 000 with surety of same amount in connection with alleged raped case of minor girl found in a paddy filed located at Nongada Maning Leikai (Santipur) Hiripat on February 26, 2020 night.
The alleged accused of the case Sanasam Malemnganba alias Nganba, 24 son of Sanasam Inao of Sawombung VDF Post Leirak and suspected Laishram Tangba alias Chinglensana, 23 son of Jillangamba of Sawombung Thongkhong, who was arrested in connection with the case was produced before the court of Special Judge POCSO, Imphal East Friday and with a prayer for remanding them in police custody remand for further investigation of the case
On the other hand, the counsel of the alleged suspect of the case filed remand objection along with a prayer for releasing on bail.
The IO of the case through APP submitted that on February 27, 2020 mother of the minor victim lodged a complaint before the Women Police Station Imphal East stating that her daughter was sexually assaulted without consent at Hiripat, Nongada Santipur by alleged accused and also suspected that a friend of alleged accused might have also be involved in the heinous crime.
On preliminary examination of the victim stated that she was sexually assaulted by the alleged accused Sanasam Malemnganba at Hiripat in the bushes and no one other than the alleged accused was involved in the heinous crime.
Accordingly, the police team submitted the report to the Chairperson of Child Welfare Committee CWC), Imphal East to take up a necessary action and as per the instruction of the Chairperson of CWC Imphal East the victim minor has been kept at open shelter home located at Imphal weast for through examination of the minor victim.
During the course of that the alleged accused Sanasam Malemnganba and suspect Laishram Tangba was arrested by a police team and handed over to Women Police Station.
During the interrogation, the alleged accused Sanasam Malemnganba admitted to have committed the charges leveled against him and also stated that the suspect L. Tangba was not involved in the said crime and the alleged accused is reluctant to disclose the fact of the case.
On the other hand, the suspected deny the charges leveled against him and claimed innocent and thus prayer for remanding the alleged accused into police custody for four days and to pass a deem fit order in respect of the suspect Tangba.
The court heard Special PP, counsel of suspect and on perusal the material on record observed that the charges leveled against the alleged accused Sanasam Malemnganba is for committing penetrative sexual punishable under Section 4 of POCSO Act.
The court also observed that the IO in her prayer had submitted that no satisfactory evidence is found against the suspected person and court may pass an order which deems fit.
The court on perusal of record find satisfied ground for remanding the alleged accused Sansam Malemnganba into police custody for further proper investigation and on the other court find no prima facie evidence for further detention of suspect in police custody.
Hence, the court remanded the alleged accused into police custody for four days till March 2, 2020 and on the other suspected is released on bail on his execution of PR bond of Rs.50, 000 with one surety of the same amount.
